THE SIGNAL RETREAT - TERMS & CONDITIONS
AGREEMENT TO TERMS
By submitting an application and/or making payment for The Signal Retreat ("Retreat") organized by Dom Henderson and Jumpstart Coaching Lab ("Organizer"), you ("Participant") agree to be bound by these terms and conditions.
RETREAT DETAILS
Event: The Signal Retreat
Dates: December 8-12, 2025
Location: Tesoro del Bosque Villa, Tamarindo, Costa Rica
Investment: $15,000 USD (all-inclusive)
Capacity: Limited to 10 participants plus spouses/partners
PAYMENT TERMS
● Investment and Payment Schedule
● Full payment of $15,000 due by November 15th, 2025, OR
● 50% deposit ($7,500) due upon acceptance, remaining 50% due by December 1st, 2025
● Credit card processing fees (3.3%) apply to all card payments
● Payment confirms acceptance of all terms and conditions
Cancellation and Refund Policy
Participant Cancellation:
➢Before November 1st: 50% refund ($7,500)
➢November 1st - November 15th: 25% refund ($3,750)
➢After November 15th: No refund due to non-recoverable costs
● Organizer Cancellation: Full refund if event cancelled by Organizer
● Force Majeure: See separate section below
ASSUMPTION OF RISK AND RELEASE OF LIABILITY
Acknowledgment of Risks
Participant acknowledges that the Retreat involves inherent risks including but not limited to:
● International travel to Costa Rica
● Water-based activities (charter boat excursions, beach activities)
● Consumption of food and alcoholic beverages
● Transportation in foreign country
● Villa accommodation and property activities
● Weather-related conditions
● Medical emergencies in remote locations
Assumption of Risk
Participant voluntarily assumes all risks associated with participation in the Retreat and related activities. Participant acknowledges that no activity is completely safe and that injuries, illness, or property damage may occur.
Release and Waiver
Participant releases, waives, and discharges Organizer, villa operators, transportation providers, charter boat companies, and all related parties from any and all claims, demands, or causes of action arising from participation in the Retreat, including but not limited to:
● Personal injury or death
● Property damage or loss
● Emotional distress
● Financial loss beyond Retreat investment
Limitation of Liability
Organizer's total liability shall not exceed the amount paid by Participant for the Retreat ($15,000). Organizer is not liable for consequential, incidental, or punitive damages.
HEALTH AND MEDICAL REQUIREMENTS
Health Disclosure
Participant must disclose any medical conditions, allergies, dietary restrictions, or physical limitations that could affect participation or require accommodation.
Medical Fitness
Participant represents they are physically and mentally capable of participating in all Retreat activities, including:
● Charter boat excursions (potential motion sickness)
● Beach and water activities
● Walking on uneven surfaces
● Tropical climate conditions
● Consumption of local foods and beverages
Medical Insurance
Participant is responsible for obtaining adequate health and travel insurance covering international travel and medical emergencies in Costa Rica.
Medical Emergencies
Organizer will assist with medical emergencies but is not responsible for medical costs, evacuation expenses, or treatment decisions.
TRAVEL AND IMMIGRATION REQUIREMENTS
Documentation
● Participant is solely responsible for:
● Valid passport (must be valid through June 2026)
● Any required visas or travel permits
● Compliance with Costa Rican immigration requirements
● COVID-19 or other health documentation if required
Travel Arrangements
● Participants responsible for booking and paying for own airfare
● Recommended arrival: December 8th by early afternoon at Liberia (LIR) airport
● Airport transport to villa provided for December 8th arrivals
● Travel delays or cancellations are Participant's responsibility
ACCOMMODATION AND ACTIVITIES
Villa Accommodation
● Private ensuite accommodation provided
● Shared common areas with other participants
● Participant responsible for any property damage caused by themselves or their guests
Included Activities
● All meals and beverages (December 8-11)
● Charter boat sunset experience
● Beach bonding activities
● All retreat programming and materials
● Airport transport (December 8th and 12th)
Excluded Activities
● Personal spouse/partner entertainment
● Off-property excursions chosen by Participant
● Additional meals or drinks beyond scheduled service
● Transportation for personal exploration
Activity Participation
Participation in activities is voluntary. Participant may decline any activity but no refund will be provided for unused services.
CONDUCT EXPECTATIONS
Professional Behavior
Participants are expected to:
● Maintain professional and respectful behavior
● Respect privacy and confidentiality of other participants
● Follow local laws and customs
● Consume alcohol responsibly
No Smoking Policy
The Signal Retreat is a smoke-free experience. Smoking (including cigarettes, cigars, vaping, and e-cigarettes) is prohibited:
● Inside all villa accommodations and common areas
● During all retreat sessions and activities
● On the charter boat experience
● During group meals and gatherings
● Participants who wish to smoke must do so in designated outdoor areas away from other participants and may not disrupt retreat programming for smoking breaks.
Disruptive Behavior
Organizer reserves the right to remove any participant whose behavior is deemed disruptive, dangerous, or inappropriate. No refund will be provided for removal due to conduct violations.
PRIVACY POLICY AND MEDIA CONSENT
Information Collection and Use
We collect personal information through the application process including but not limited to:
● Contact information (name, email, phone, address)
● Business information (firm details, revenue, goals)
● Personal information (dietary restrictions, health considerations, emergency contacts)
● Payment and financial information
This information is used solely for:
● Retreat organization and logistics
● Emergency contact purposes
● Customizing retreat experience
● Payment processing
● Future communication about related services
Information Sharing and Disclosure
Personal information will not be shared with third parties except:
● As necessary for retreat logistics (villa, transportation, vendors)
● In case of medical emergencies
● As required by law
● With explicit written consent from Participant
Photography, Video, and Recording Consent
Comprehensive Media Release Participant grants Organizer unlimited, perpetual, worldwide rights to:
● Photograph, film, and record Participant during all retreat activities
● Use Participant's name, likeness, voice, and image in any media format
● Distribute content through any channels (social media, websites, marketing materials, courses)
● Edit, modify, and combine content as deemed appropriate
Commercial Use Authorization Participant specifically consents to use of their image and content for:
● Marketing and promotional materials for future retreats
● Social media content and advertising
● Website testimonials and case studies
● Educational courses and training materials
● Books, articles, and publications
● Speaking engagements and presentations
No Compensation Participant waives any right to compensation for use of their image, likeness, or statements.
Content and Intellectual Property Ownership
Organizer-Created Content All content created during the retreat belongs exclusively to Organizer, including:
● Video and audio recordings of all sessions
● Participant testimonials and statements
● Photos and media from all activities
● Workshop materials and frameworks
● Group discussions and mastermind sessions
Participant-Shared Information Any personal strategies, business information, or insights shared by Participant during the retreat become part of Organizer's content library and may be used for:
● Future educational materials (with identifying information removed as appropriate)
● Case studies and examples
● Training and coaching programs
Future Content Access Organizer may offer access to retreat recordings and materials through:
● Premium mastermind subscriptions
● Educational courses
● Coaching programs
● Other paid services
Participant understands they have no automatic right to access recordings and must purchase any future access separately.
Testimonial and Promotional Use
Automatic Consent for Promotional Materials By participating, Participant consents to use of:
● Before/after business transformation stories
● Revenue increase testimonials
● Personal success stories
● Quotes and statements made during retreat
● Follow-up success updates
Ongoing Promotional Rights Organizer may contact Participant for up to 2 years post-retreat for:
● Success story updates
● Additional testimonials
● Case study development
● Promotional interviews
Participant may decline specific requests but cannot revoke general consent already granted.
Opt-Out Provisions
Limited Opt-Out Options Participant may opt out of:
● Future marketing communications (retreat-related content cannot be opted out)
● Specific promotional interview requests
● Direct contact for testimonials (but cannot prevent use of content already captured)
What Cannot Be Opted Out:
● Content already recorded during retreat
● Photos/videos taken during group activities
● Testimonials and statements already made
● Business transformation stories and results
Data Retention
Personal information and media content will be retained indefinitely for:
● Legal compliance and liability protection
● Educational and promotional purposes
● Future business opportunities
International Data Transfer
By participating in Costa Rica retreat, Participant consents to international transfer and processing of personal data.
Third-Party Services
We may use third-party services for:
● Payment processing (credit card companies)
● Video hosting and distribution
● Email marketing and communications
● Customer relationship management
These services have their own privacy policies and data handling practices.
Confidentiality Obligations
While Participant grants broad media and content rights to Organizer, Organizer agrees to:
● Protect sensitive business information not intended for public use
● Remove or blur confidential financial documents if accidentally recorded
● Use reasonable discretion in sharing personal family information
● Maintain confidentiality of private medical information disclosed
Changes to Privacy Policy
Organizer reserves the right to update this privacy policy. Changes will not affect content and consent already granted.
INTELLECTUAL PROPERTY AND CONFIDENTIALITY
Confidentiality
Discussions, frameworks, and personal information shared during the Retreat are confidential. Participants agree not to disclose other participants' personal or business information.
Media Consent
Participant consents to being photographed/recorded during the Retreat for marketing purposes unless specifically opted out in writing.
Proprietary Content
All retreat materials, frameworks, and content remain the intellectual property of Dominique Henderson, Sr. and DJ Henderson Consulting, LLC d/b/a/ "The Jumpstart Coaching Lab."
FORCE MAJEURE
Organizer is not liable for cancellation or modification due to circumstances beyond reasonable control, including:
● Natural disasters (hurricanes, earthquakes)
● Government restrictions or travel bans
● Political instability
● Public health emergencies
● Villa or vendor unavailability
In force majeure situations, Organizer will attempt to reschedule or provide alternative arrangements. Refunds subject to recovery of prepaid vendor costs.
PRIVACY AND DATA PROTECTION
Information Collection
Personal information collected through application process will be used solely for Retreat organization and related communications.
Information Sharing
Personal information will not be shared with third parties except as necessary for Retreat logistics (villa, transportation, etc.).
DISPUTE RESOLUTION
Governing Law
These terms are governed by the laws of Texas.
Jurisdiction
Any disputes arising from these terms or the Retreat shall be resolved in the courts of Dallas, TX, Dallas County.
Mediation
Parties agree to attempt good-faith mediation before pursuing litigation.
SPOUSE/PARTNER PROVISIONS
Inclusion Policy
Spouse/partner attendance is limited to personal relationships only (not business partners or colleagues).
Responsibility
Participant is fully responsible for spouse/partner's conduct and any damages caused by spouse/partner.
Activities
Spouses/partners are welcome at group meals and charter boat experience but are responsible for their own entertainment during business sessions.
ADDITIONAL PROVISIONS
Entire Agreement
These terms constitute the entire agreement between parties and supersede all prior agreements or understandings.
Modification
Terms may only be modified in writing by Organizer. Continued participation after modification constitutes acceptance.
Severability
If any provision is deemed invalid, remaining provisions remain in full effect.
Age Requirement
Participants must be at least 21 years of age. Minors are not permitted.
EMERGENCY CONTACT INFORMATION
Participants must provide emergency contact information for next-of-kin not traveling to Costa Rica.
ACKNOWLEDGMENT
By submitting application and/or making payment, Participant acknowledges:
● Having read and understood all terms and conditions
● Voluntary assumption of all described risks
● Agreement to be legally bound by these terms
● Understanding that terms are legally binding and may limit legal rights
IMPORTANT: Participant is strongly encouraged to consult with an attorney before agreeing to these terms.
